1. Acceptance of Terms

By downloading, installing, or using the CrushMax application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

CrushMax is an AI-powered appearance analysis and match scoring application. You upload photos of yourself and a person you are interested in, and the App provides a match score, category breakdowns, and improvement suggestions using artificial intelligence.

3. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent that you meet this age requirement. If you are under 18, you should review these Terms with a parent or guardian.

4. User Conduct

You agree that you will not:

  • Upload photos of minors.
  • Upload photos of individuals without their knowledge or consent in jurisdictions where such consent is required.
  • Upload obscene, illegal, or harmful content.
  • Use the App to harass, bully, or harm any individual based on the results provided.
  • Attempt to reverse-engineer, decompile, or exploit the App or its backend services.
  • Use automated tools, bots, or scripts to access or interact with the App.
  • Circumvent rate limits, concurrency controls, or other technical restrictions.

5. Photos and Content

  • You retain ownership of any photos you upload. By uploading photos, you grant us a limited license to process, store, and transmit them solely for the purpose of providing the App's services (AI analysis and score generation).
  • Photos are sent to third-party AI providers (OpenAI and/or Google Gemini) for analysis. You acknowledge and consent to this processing.
  • You represent that you have the right to upload any photos you submit and that doing so does not violate any third party's rights.

6. AI-Generated Content

All scores, analyses, tier labels, and improvement suggestions provided by the App are generated by artificial intelligence and are for entertainment and informational purposes only. Results are not professional advice (medical, psychological, or otherwise). We make no guarantees about the accuracy, completeness, or usefulness of AI-generated content.

7. Account and Data Deletion

You can delete your account and all associated data (profile, scans, photos, cached analyses) at any time through the Settings screen in the App. Deletion is permanent and cannot be undone. If you uninstall the App without deleting your account, you may contact yashgarg.studio@gmail.com to request data deletion.

8. Intellectual Property

The App, its design, branding, scoring algorithms, prompts, and all related intellectual property are owned by CrushMax. You may not copy, modify, distribute, or create derivative works based on the App or its content without our prior written consent.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or that results will be accurate. You use the App at your own risk.

10. Limitation of Liability

To the maximum extent permitted by applicable law, CrushMax and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to emotional distress, loss of data, or reliance on AI-generated content.

11. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the App (or any part of it) at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the App.

12. Changes to These Terms

We may revise these Terms at any time by updating this page. The "Last updated" date will be changed accordingly. Continued use of the App after any changes constitutes your acceptance of the new Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
